Welcome to Destiny Springs Condominiums

 Destiny Springs Condominiums is a 249-unit, deed-restricted condominium community offering a range of unit configurations from studios and one-bedroom residences , two bedrooms units. and three bedrooms units. Community amenities include three swimming pools, a tennis court, fitness center, clubhouse, two on-site laundry facilities, and a car wash station, all maintained for the use and enjoyment of residents in accordance with the Association’s governing documents. 


 This page serves as an official informational resource for unit owners and residents of Destiny Springs Condominiums. It provides access to Association governing documents, rules and regulations, meeting notices, and other information maintained in accordance with Florida Statute Chapter 718. Information provided is for convenience only and does not replace the Association’s official records or recorded governing documents. 

Application Submission Requirements Destiny Springs Condominium Association, Inc.

  

All applications must be submitted in writing, complete, and accompanied by the required application fee as established by the Association and its governing documents.

  • Application fees must be paid by Money Order or Cashier’s Check only
     
  • Personal checks, cash, credit cards, or electronic payments are not accepted
     
  • All application fees are NON-REFUNDABLE, regardless of approval or denial
     

Application Requirements

  • Applications may not be submitted online or by email
     
  • All applications must be submitted in hard-copy (paper format) only
     
  • Applications must include all required information, documentation, and applicable fees
     
  • Incomplete applications, or applications missing required documents or fees, will not be accepted or processed
     
  • Submission of an application does not constitute approval

Administrative Notice & Legal Responsibilities

The Association’s office staff and Community Association Manager (CAM):

  • Do not assist tenants
     
  • Do not answer tenant questions
     
  • Work exclusively with:
     
    • Unit Owners
       
    • Licensed Property Managers
       
    • Licensed Real Estate Professionals
       
    • Authorized representatives with written owner authorization
       

This policy is consistent with Florida Statutes Chapter 718, which establishes that the Association’s legal and contractual relationship is with the unit owner, not tenants or occupants.

Owner, Realtor, and Property Manager Responsibilities

Unit Owners

Pursuant to Florida Statutes §§718.104 and 718.303, unit owners are responsible for:

  • Assisting their tenants and prospective buyers
     
  • Ensuring all required applications are properly completed and submitted
     
  • Serving as the primary contact with the Association unless a property manager is formally designated
     

Realtors

Licensed real estate professionals are responsible for:

  • Providing buyers with accurate Association information
     
  • Ensuring buyers comply with Association approval requirements prior to occupancy
     
  • Directing clients to submit paper applications only, as required
     

Property Managers

Any new or replacement property manager must:

  • Submit a fully executed management agreement to the Association
     
  • Provide written authorization before acting on behalf of the unit owner
     
  • Handle all tenant communications and onboarding assistance

Electric service for individual units is provided directly by Duke Energy Florida.

  • Paying all charges directly to the provider

Water usage is billed to unit owners through National Exemption Service (NES) in accordance with the community’s utility billing structure.

Where can I find the Rules & Regulations?

The Association’s Rules & Regulations, Declaration, and governing documents are published on this website and are available for everyone to review.

All owners, residents, tenants, guests, and contractors are responsible for knowing and complying with these rules.

Ownership & Records

How do I update my mailing address or contact information?

Owners must keep their mailing address, email, and phone number current with the Association.
Owners with tenant-occupied units must maintain a separate mailing address on file.

Updates must be submitted in writing by email or at the clubhouse.

How do I request Association records?

Official records may be requested:

  • In person at the clubhouse during office hours

Requests are processed in accordance with Florida Statute §718.111(12).

Assessments & Payments

When are monthly assessments due?

Assessments are due on the 1st day of each month, per the approved annual budget.

Are late fees applied?

Yes. Late fees, interest, and collection actions may apply as provided in the governing documents and Florida Statute Chapter 718.

Leasing & Tenants

Can tenants move in without HOA approval?

No. Written HOA approval is required before tenant occupancy. Tenants may not move in until the HOA application is completed, approved, and all required documents are on file.

What is the tenant application fee and how long does tenant appliation take?

Please contact the Clubhouse directly for current tenant application fee information, and complete appliations are processed within up to 10 business days.

Does the lease need to be renewed with the Association?

Yes. All leases must be renewed with the Association each year.

A current, fully executed lease must be submitted to the Clubhouse annually
Owners are responsible for ensuring lease renewals are filed on time
Failure to renew lease documentation may result in administrative enforcement, including temporary suspension of access credentials

Are there pet or animal restrictions?

Yes. Pet approvals are subject to Association rules and insurance restrictions. Certain animals may not be permitted due to insurance limitations.

Parking Rules

How many parking spaces are assigned per unit?

Each unit is assigned one (1) parking space only.

Parking in unassigned spaces, fire lanes, or restricted areas is prohibited and may result in enforcement action.

Hallways & Common Areas

Are items allowed in hallways?

No. No items are permitted in hallways or common areas at any time.

This includes, but is not limited to:

  • Bicycles
  • Boxes
  • Plants or planters
  • Furniture
  • Scooters or personal items

What happens if items are left in the hallway?

Any item left in the hallway may be removed without further notice, and all removal and disposal costs will be charged to the unit owner, pursuant to the governing documents and Florida Statute §718.303.

Owners are responsible for compliance by their tenants and guests.

Balconies & Patios

Can balconies or patios be used?

Use of balconies and patios may be temporarily restricted due to repairs, inspections, or safety concerns.

When restrictions are in place:

  • No use or storage is permitted
  • Temporary access is allowed only to remove items
  • No verbal permissions override written notices

Owners are responsible for ensuring tenant compliance.

Contractors & Repairs

Do contractors or handymen need to register?

Yes. All contractors, handymen, and general contractors must be registered at the clubhouse before starting any work, as required by the Rules & Regulations.

Violations & Enforcement

How are violation notices delivered?

Violation notices are sent by email to the owner’s email address on file with the Association.

Owners are responsible for:

  • Keeping a valid email address on file
  • Monitoring email communications
  • Ensuring messages are not blocked or sent to spam

Failure to receive an email due to outdated contact information does not waive enforcement, as permitted under Florida Statute §718.303.

Am I responsible for my tenant’s violations?

Yes. Owners are responsible for all violations related to their unit, including those caused by tenants, occupants, or guests.

Access & Amenities

How do I obtain key cards or access credentials?

Access credentials are issued after ownership and/or tenant documentation is complete and approved.

Can access be suspended?

Yes. Access may be temporarily suspended for administrative reasons, including missing lease documentation or non-compliance with Association requirements.

Trash & Bulk Items

Where should trash be disposed of?

Trash must be placed inside designated dumpsters only.

Are bulk items allowed near dumpsters?

No. Bulk items must be disposed of by the owner. Items left near dumpsters may be removed and charged back to the unit owner.

Safety & Emergencies

Who do I contact in an emergency?

For emergencies, call 911.
For non-emergency community matters, contact management in writing.

 🚫 Illegal Dumping Prohibited

Florida & Seminole County Law Applied

The dumping or disposal of trash, furniture, construction debris, appliances, or any waste outside of designated dumpsters or waste containers is strictly prohibited within Destiny Springs Condominium Association, Inc.

This includes, but is not limited to, placing items:

  • On grass or landscaped areas
     
  • Next to, behind, or surrounding dumpsters
     
  • On sidewalks, streets, parking areas, or any common elements
     

Such actions constitute illegal dumping and are a direct violation of:

  • The Association’s Declaration, Rules & Regulations
     
  • Florida Statute §403.413 – Florida Litter Law
     
  • Florida Statute §718.303 – Obligations of Unit Owners; Fines
     
  • Seminole County Code of Ordinances (Illegal dumping and solid waste disposal regulations)
     

⚖️ Florida & Seminole County Legal Authority

📘 Florida Law

Under Florida Statute §403.413, it is unlawful to dump or dispose of litter, waste, or solid materials on public or private property without proper authorization. Violations may result in civil penalties and criminal prosecution.

Under Florida Statute §718.303, the Association may levy fines, suspend use rights, and take enforcement action against unit owners for violations committed by the owner, occupants, tenants, or guests.

🏛 Seminole County Law

Under the Seminole County Code of Ordinances, illegal dumping and improper disposal of solid waste are prohibited and subject to enforcement by Seminole County Code Enforcement, including civil fines and cleanup orders.

🚨 Fines, Charges & Enforcement

Violators may be subject to one or more of the following:

  • 💰 Association fines as authorized by the governing documents and §718.303, Fla. Stat.
     
  • 💸 Reimbursement of cleanup and hauling costs charged to the unit owner
     
  • 📑 Lien placement for unpaid charges, as permitted by Florida law and the governing documents
     
  • 🚓 Civil or criminal penalties imposed by Seminole County or the State of Florida, including fines of up to $1,000 per violation and possible jail time for repeat or large-scale offenses
     

✅ Community Reminders (Owner & Tenant Responsibility)

  • Do NOT dump furniture, appliances, construction debris, or bulk items on Association property
     
  • Do NOT leave trash or bulk items beside dumpsters
     
  • All household waste must be placed fully inside designated dumpsters
     
  • Unit owners are legally responsible for violations caused by their tenants, occupants, or guests
     
  • Bulk items must be disposed of through:
     
    • Seminole County-approved bulk pickup services, or
       
    • A licensed private hauling company

Florida Law & Local Compliance

To maintain safety, order, and compliance with the Association’s governing documents, unauthorized, improperly parked, or prohibited vehicles within Destiny Springs Condominium Association, Inc. are subject to towing 24 hours a day, 7 days a week.

Towing is strictly enforced pursuant to:

  • Florida Statute §715.07 (Vehicles parked on private property; towing authority)
     
  • The Association’s Declaration, Rules & Regulations
     
  • Applicable local ordinances

All towing, storage, and administrative fees are:

  • Charged directly to the vehicle owner

⚠️ Violations Subject to Immediate Towing

Vehicles may be towed without prior notice, as permitted by law, for any of the following:

  • Illegal or unauthorized parking
     
  • Inoperable or abandoned vehicles (including vehicles unable to operate under their own power)
     
  • No tag, expired tag, or invalid license plate
     
  • Vehicles advertised “For Sale”
     
  • Double parking
     
  • Parking on grass or landscaped areas
     
  • Parking in fire lanes or emergency access areas
     
  • Parking in front of or beside dumpsters
     
  • Parking in handicap spaces without a valid permit
     
  • Unauthorized or unassigned parking spaces
     
  • Backed-in parking where prohibited by posted signage or adopted Association rules
     
  • Parking of unauthorized vehicles, including but not limited to:
     
    • Boats
       
    • Jet skis
       
    • RVs
       
    • Trailers
       
    • Commercial or semi-trucks
       
  • Vehicles with car covers without a clearly visible license plate
     
  • Vehicles not parked fully within the marked lines of an assigned space

  • Towing signage is posted at community entrances and designated areas
     
  • All residents, tenants, and visitors are responsible for compliance
     
  • Vehicles in violation may be towed at the owner’s expense and without prior warning, as permitted by law

  • Vehicles must be parked fully within assigned spaces
     
  • License plates must be clearly visible at all times
     
  • Residents are responsible for their guests’ compliance
     
  • No mechanical repairs or vehicle maintenance are permitted in parking areas or common elements
